Work Permits (LMIA & LMIA-Exempt)

A Canadian work permit authorizes foreign nationals to work legally in Canada for a specific employer, location, and duration (closed work permit) or for any employer (open work permit). Work permits are generally divided into two categories: those that require a Labour Market Impact Assessment (LMIA) from Employment and Social Development Canada (ESDC), and those that are LMIA-exempt under the International Mobility Program (IMP).

LMIA-based work permits require your Canadian employer to demonstrate that no qualified Canadian citizen or permanent resident is available for the position. LMIA-exempt work permits include intra-company transfers, reciprocal employment agreements (such as those under CUSMA/USMCA), significant benefit to Canada (including performing artists and athletes), and spousal or dependent open work permits for certain visa holders.
